Is this fair???

Well, it definitely isn't fair, since an honest work deserves an honest fair, whether they are family or ex-family (ex-in-laws). Family and business should be two separate things. I think it would be helpful to always make sure you have the business arrangements in "black and white" to avoid this incident to occur again.
