Does anyone know what will happen if i was servered a ex parte order and did not get it, is it still effective

My wife and i have just started our divorce. There are no orders in place yet. out court date is not until july but we have child mediator in two weeks. last week i picked my daughter up form daycare. keep in mind that i have not seen her in three weeks. her mother has been keeping me from her. sho moved out ofteh house 2 months ago. (i do have a lawyer) last Thursday i had my uncle babysit her while i worked. to find out i get a call from my uncle informing me that my wife and the police are at his house claiming that i abducted my daughter. Well my roommate informed me that a server was looking for me that day. to come to find out my lawyer informed me that the order is invalid because i was not properly servered. well we have a court hearing 2marrow discussing this order. in the statement my wife claims that i took my daughter form daycare evern thought the day care staff called her to inform her. is that dirty or what. does anyone or had a simler experience like that before?
